In a major breather for newly appointed government employees, the Law Commission headed by Justice (retired) M K Hanjura has recommended reduction in probation period from five to two years under SRO-202.
In 2015, then PDP-BJP government in Jammu and Kashmir hadintroduced SRO-202 which fixed five year probation period for new appointees.The move since its implementation has been facing opposition from bothgovernment employees as well as the educated youth in J&K.
Coming down heavily on makers of this SRO, the Commission inits report submitted to Chief Secretary BVR Subrahmanyam said, “They kept theSword of Damocles hanging high on the heads of this set of employees.”
The Law Commission hasrecommended that words “five years” wherever appear in SRO-202 shall bereplaced with “two years” which will not only be in tune and in line withOffice Memorandum of Department of Personnel and Training, Government of India,but will also be in consonance with the evolved concept of justice andequality.
“Those employees who have completed two years of probationon the date of the promulgation of Jammu and Kashmir Re-organisation Act 2019may be regularized subject to the conditions laid down in the SRO and the casesof those employees who will be completing two years of probation on any futuredate may be taken up for such consideration on such dates,” the Law Commissionrecommended.
“The period of probation for direct recruitment to thenon-gazetted posts has to keep pace and affinity with Rule 3(i) of the officememorandum of the DOPT,” it reads.
