Under what law Centre for PIL, LA has been constituted: HC asks CUK

Srinagar, Dec 3: High Court of J&K and Ladakh High has directed Dean School of Legal Studies, Central University of Kashmir (CUK) to inform it by December 31 under what provisions of law the Centre for Public Interest Litigation (PIL) and Legal Aid (LA) has been constituted.

A division bench of Chief Justice Pankaj Mithal and Justice Muhammad Akram Chowdhary sought to know the information while hearing a Public Interest Litigation ( PIL) filed by the Centre for Public Interest Litigation and Legal Aid, a constituent Institute of the Central University of Kashmir through one of its student.

The bench also asked the Dean School of Legal Studies (Ex-Officio Chairman), Centre for Public Interest Litigation and Legal Aid, to come forward and disclose clearly the nature and status of the Institution and who its overall incharge is.

While the bench pointed out that the Dean or the Ex-officio Chairman of the Institute or any officer of the varsity has not come forward to file the petition, it said, “The student has only been authorized to file and argue the petition on behalf of the Institute but he is not authorized to file the petition in the name of the Institute through himself.”

The Court also asked the asked Ex-officio Chairman of the Institute to delineate who is overall incharge and under what provisions of law the same has been constituted.
